Americans in Chinese Courts

The U.S.‑China relationship has come to be defined by geopolitical rivalry. The siren is loud and everywhere, even engulfing civil litigation. This talk examines the U.S.-China relationship from a quieter, more bottom-up perspective: what does the actual experience of Americans litigating in China look like? Relying on a novel dataset of nearly 4000 cases collected during a brief window of access to Chinese court documents, this research shows that the geopolitical lens not only misses much of the content of U.S.-China litigation but fails to capture pressing challenges that American litigants and judges encounter on the frontlines. Due to a recent retreat from judicial transparency under Party General Secretary Xi Jinping’s regime, this project is likely our only opportunity to observe these interactions during Xi’s time in power.
